Acceptable Use Policy

Introduction

This Policy describes how the Platform may and may not be used. Its purpose is to keep Xmentra a safe, lawful, respectful, and reliable place to learn — for you, for other learners, for third parties, and for the Platform itself.

It is deliberately proportionate. Language learning means engaging with real life, including subjects that are difficult, so this Policy is written to prohibit misuse without discouraging legitimate study. Where a rule could be read either way, section 25 governs.

This Policy owns the behavioural and technical rules for using the Platform. It forms part of the Terms of Use (/terms), which own the contractual terms, liability, and governing law. AI capability and its limits are owned by the AI & Educational Use Policy (/ai-policy). Data practices are owned by the Privacy Policy (/privacy). Ownership, licences, and infringement reporting are owned by the Copyright & Intellectual Property Policy (/copyright-policy).

1. Definitions

These definitions are shared across all Xmentra legal documents and are reproduced without modification.

• Platform — the Xmentra website at https://xmentra.com, together with any applications, subdomains, and interfaces operated by Xmentra.
• Services — all functionality offered through the Platform, including lessons, learning experiences, vocabulary, grammar, listening, revision, progress tracking, the educational blog, and any features added later.
• AI Features — any part of the Services that uses automated language models or similar techniques to generate, adapt, evaluate, or respond to content, including the AI Mentor and AI Conversations when introduced.
• Content — any text, audio, image, code, exercise, translation, or other material available through the Platform, whether created by Xmentra, generated by AI Features, or submitted by a User.
• Educational Content — Content published by Xmentra for learning purposes, including lessons, learning experiences, explanations, audio, and blog articles.
• Personal Information — information that identifies, or can reasonably be used to identify, an individual, either alone or combined with other information available to Xmentra.
• Learning Data — information about a User's learning activity, such as lessons opened, experiences completed, confidence responses, saved vocabulary, and revision history.
• Local Storage — browser storage mechanisms (including localStorage and sessionStorage) used by the Platform to keep information on the User's own device.
• Third Party Services — independent providers whose infrastructure or tools support the Platform, including hosting, analytics, and, where applicable, payment, communication, and AI providers.
• User — any person who accesses or uses the Platform, with or without an Account.
• Account — a credentialed profile that a User may create when Accounts are available, allowing Learning Data to be stored by Xmentra rather than only on the device.
• Subscription — a recurring paid arrangement granting access to Premium Features, where such arrangements are offered.
• Premium Features — Services available only under a Subscription or other paid plan.
• Community — any feature allowing Users to interact with one another, including forums, comments, groups, or shared practice.

2. Purpose of this Policy

This Policy exists so that the Platform stays:

• safe — free from conduct that harms or endangers people;
• lawful — used in ways that comply with applicable law;
• respectful — a place where learners are treated decently;
• reliable — technically available and working for everyone;
• educational — used for learning rather than against it.

It is not intended as a list of threats. It is the small set of boundaries that allows an open, largely anonymous learning platform to stay open.

3. Who this Policy Applies To

This Policy applies to every User who accesses or uses the Platform or the Services, with or without an Account, and to any use of the Platform by a person or organisation acting on a User's behalf. Some sections apply only to functionality that exists — where a section is conditional, that is stated.

4. General Rule

You may use Xmentra for legitimate educational purposes and for purposes reasonably related to them, consistent with the Terms of Use (/terms) and this Policy.

That includes learning, practising, revising, reading, listening, taking notes for your own study, using the Platform in your own teaching or study routine, and sharing links to Platform pages. The prohibitions below describe misuse; they are not intended to narrow ordinary learning use, and anything not prohibited here or in the Terms of Use is not prohibited by implication.

5. Unlawful Use

You may not use the Platform for any purpose that is unlawful under the law applicable to you, or to facilitate unlawful activity by others.

Laws differ between countries, and this Policy does not attempt to list them. You are responsible for the legality of your own use where you are.

6. Harmful or Abusive Conduct

You may not use the Platform, or any functionality within it, in order to:

• threaten a person;
• harass, bully, or intimidate a person;
• abuse or degrade a person;
• exploit a person, including financially or sexually;
• stalk a person or track them without their consent;
• encourage or facilitate serious harm to a person, including self-harm.

Learner-to-learner interaction, messaging, comments, and Community functionality are not currently offered, so this section applies principally to communications sent to Xmentra, to use of AI Features, and to any interactive functionality introduced later. It applies in full to that functionality from the moment it becomes available.

7. Hateful and Discriminatory Misuse

Where interactive functionality is available, you may not use it to promote, incite, or facilitate unlawful discrimination or seriously abusive conduct directed at people on the basis of characteristics such as race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age, or migration status.

This rule targets misuse, not subject matter. Learning a language properly involves reading news, studying history, discussing discrimination and prejudice, translating difficult material, and understanding language that people actually use, including language that is offensive. That work is legitimate and is not restricted by this section. Section 26 states this protection explicitly.

8. Child Safety and Sexual Exploitation

You may not use the Platform in connection with the sexual exploitation or abuse of a minor, or with any other material or conduct that unlawfully exploits a person.

This rule is absolute and admits no educational, artistic, or research exception. Where we become aware of such use, we will act, and we will preserve and report information where legally required to do so.

9. Violence and Dangerous Misuse

You may not use the Platform, including AI Features, in order to plan, encourage, or facilitate serious unlawful harm, such as violence against people, terrorism, trafficking, or the creation or acquisition of weapons or other means of causing serious harm.

Ordinary educational engagement with these subjects — vocabulary for news reporting, historical study, translation of factual material, or discussion of safety and conflict — is not prohibited. What is prohibited is use directed at bringing about serious unlawful harm.

10. Fraud, Deception, and Impersonation

You may not use the Platform to:

• carry out or facilitate fraud or a scam;
• engage in phishing or the theft of another person's identity;
• impersonate another real person, Xmentra, or an organisation in a way intended to deceive;
• create or use deceptive credentials, qualifications, or claims of accreditation;
• misrepresent an association with Xmentra.

Role-play is a normal part of language learning. Practising a phone call, introducing yourself as a fictional character, playing a customer, a patient, or an interviewer, or writing a dialogue between invented people is legitimate practice and is not impersonation within the meaning of this section.

11. Security Abuse

You may not:

• access, or try to access, any part of the Platform, a system, or data without authorisation;
• bypass, disable, or circumvent security, authentication, or access controls;
• probe or exploit a vulnerability in order to cause harm or gain unauthorised access;
• introduce malware, or any code intended to damage or gain unauthorised control;
• carry out credential attacks, including credential stuffing or brute-force attempts, where Accounts exist;
• interfere with the normal operation of the Platform or Third Party Services;
• attempt to access, alter, or delete another User's information or Learning Data.

Responsible security research is not categorically prohibited. Where you believe you have found a vulnerability, contact hello@xmentra.com and give us a reasonable opportunity to respond before disclosing it. A formal responsible-disclosure or bug-bounty programme is not currently offered; if one is introduced, its terms will govern.

12. Automated Access and Scraping

You may not use automated means to:

• scrape, crawl, or harvest Content in a manner that is unauthorised or that places an unreasonable load on the Platform;
• extract Educational Content in bulk, or reproduce a substantial part of it;
• build a dataset, product, or service from extracted Educational Content without authorisation;
• circumvent rate limits, access limits, or technical restrictions;
• automate abuse of any feature, including AI Features.

This section does not restrict search-engine crawling that respects the Platform's robots.txt and normal indexing conventions; the Platform is intended to be found and indexed. Ordinary browser use, accessibility tools, assistive technology, and personal tools that fetch pages at a human pace for your own study are likewise unaffected.

13. Interference with the Platform

You may not take action intended to overload, disrupt, degrade, disable, or circumvent the Platform or the infrastructure it runs on, including denial-of-service activity, deliberate resource exhaustion, or interference with other Users' access.

14. Intellectual Property Misuse

You may not infringe the intellectual property rights of Xmentra or of any third party through your use of the Platform, including by copying, republishing, redistributing, or adapting Educational Content beyond what is permitted, or by removing attribution or proprietary notices.

Detailed ownership, licence scope, and the infringement-reporting procedure are not defined here. Those are owned by the Terms of Use (/terms) and, when published, the Copyright & Intellectual Property Policy. Until that document is published, the Terms of Use govern; reports of infringement can be sent to hello@xmentra.com.

15. User Content

Functionality for Users to submit, upload, or publish Content is not currently offered.

Where such functionality is introduced, you will be responsible for what you submit, and you must submit only Content you have the right to use and share. It must not breach this Policy or the rights of others.

Nothing in this section transfers ownership of your material to Xmentra. Any licence needed to operate the Services will be set out in the Terms of Use (/terms) and the Copyright & Intellectual Property Policy (/copyright-policy) — not here.

16. Misuse of Personal Information

You may not use the Platform to obtain, collect, expose, publish, or exploit another person's Personal Information unlawfully or without their consent, and you may not use the Platform to build profiles of identifiable people for harmful purposes.

How Xmentra itself handles Personal Information is owned by the Privacy Policy (/privacy).

17. Misuse of AI Features

Where AI Features are available, you may not use them for a purpose that is unlawful or clearly harmful, including any purpose prohibited by sections 5 to 10 of this Policy, or in order to:

• generate material that sexually exploits a minor, or other unlawful exploitative material;
• generate content designed to deceive people for fraudulent purposes;
• generate targeted harassment or serious abuse of a person;
• obtain instructions for causing serious unlawful harm;
• deliberately circumvent safeguards applied to AI Features;
• submit another person's sensitive Personal Information without a lawful basis.

Normal educational experimentation is not misuse. Testing what an AI Feature can do, asking about difficult or offensive language, requesting explanations of sensitive real-world situations, or probing where a model is inaccurate are all legitimate uses of a language-learning tool. The capabilities and limits of AI Features are owned by the AI & Educational Use Policy (/ai-policy), and this section creates no AI rules that conflict with it.

18. Academic Integrity

Xmentra is an educational tool, and using an educational tool is not cheating.

Where you use the Platform in connection with a school, university, examination provider, employer, or other institution, you are responsible for following that institution's own rules about the use of learning tools, AI assistance, and outside help. Those rules differ widely, they change, and they belong to the institution rather than to us.

Xmentra does not claim authority to interpret or override another institution's academic-integrity policy, and does not characterise AI-assisted learning as academic misconduct in itself. If you are unsure whether a particular use is permitted where you study or work, ask there before relying on it.

19. Examination Misconduct

You may not use the Platform, including AI Features, during a live or controlled examination, assessment, or test where outside help is prohibited, or in any other way intended to facilitate examination misconduct.

The distinction is straightforward:

• Legitimate — preparing before an examination, practising formats, building vocabulary, revising, and rehearsing spoken tasks.
• Prohibited — using the Platform during a controlled examination, or to obtain or supply answers where doing so breaks the rules that apply to you.

Examination providers set and enforce their own rules; nothing here affects their decisions.

20. Accounts

Accounts, logins, and passwords are not currently offered; the Platform can be used without registering.

Where Accounts are introduced, you may not access an Account you are not authorised to use, obtain or use another person's credentials, share credentials in breach of the Terms of Use, or intentionally circumvent restrictions attached to an Account.

21. Unauthorised Commercial Exploitation

Commercial contexts are not prohibited as such — you may use the Platform to prepare for work, to learn for a job, or as part of your own teaching practice, consistent with the licence granted in the Terms of Use (/terms).

What is prohibited is unauthorised exploitation of the Platform or its Content, including:

• reselling, sublicensing, or charging others for access to the Platform;
• copying Educational Content in bulk for redistribution or resale;
• operating a competing or derivative service built on unauthorised extraction of Educational Content;
• circumventing restrictions attached to Premium Features, where Premium Features are offered.

Where the Terms of Use and this section differ on the scope of the licence, the Terms of Use govern.

22. Community Features

Community functionality — forums, comments, profiles, groups, or shared practice — is not currently offered.

Where Community functionality is introduced, this Policy will continue to apply, and Users will also be required to follow the Community Guidelines (/community-guidelines) published for those features.

23. Reporting a Concern

If you encounter conduct or Content that appears to breach this Policy, or output that appears harmful or seriously inaccurate, write to hello@xmentra.com.

That address is currently the only reporting route. Where it helps, include the page or feature involved, what you saw, and roughly when. No dedicated reporting interface, abuse portal, or moderation queue is currently offered; if one is introduced, it will be described here.

24. Enforcement

Where we reasonably believe this Policy has been breached, and depending on the severity of the breach and the functionality actually available, Xmentra may:

• investigate the circumstances;
• restrict or withdraw access to functionality, or to the Platform;
• apply technical measures such as rate limiting or blocking;
• remove or disable Content in breach, where the functionality to do so exists;
• suspend or terminate an Account, where Accounts exist;
• preserve, disclose, or report information where legally required, or where necessary to protect a person from serious harm.

No fixed sequence of steps is promised, and no measure is guaranteed to be applied in any particular case. Content-removal tooling, moderation systems, and Account suspension apply only where the corresponding functionality exists. Termination rights and their consequences are owned by the Terms of Use (/terms).

25. Context and Fairness

Enforcement is a judgement, not a mechanism. Where it is reasonably appropriate, we will consider:

• the context in which something happened;
• the severity and actual impact of the conduct;
• whether it appears deliberate or accidental;
• whether it is isolated or repeated;
• the effect on other Users and on third parties;
• our legal obligations.

The aim is proportion: a misunderstanding is treated as a misunderstanding, and serious or repeated misuse is treated seriously.

26. Legitimate Educational Context

This Policy is not intended to restrict legitimate language learning about difficult subjects. Language exists in the real world, and learners need the words that the real world uses.

The following are legitimate uses of the Platform and are not breaches of this Policy:

• translating or reading news, including reports of crime, conflict, or disaster;
• studying historical material, including material about atrocities and persecution;
• discussing discrimination, prejudice, or inequality in an academic or reflective way;
• learning vocabulary for difficult real-world situations, including illness, bereavement, police, legal, or emergency contexts;
• examining offensive or harmful language in order to recognise and understand it;
• practising conversations about sensitive personal topics.

Where conduct sits close to a boundary, purpose is what matters: studying language about harm is legitimate, and using the Platform to cause harm is not.

27. Questions About Enforcement

If access to functionality has been restricted and you believe that was a mistake, you may write to hello@xmentra.com explaining the circumstances, and we will consider what you tell us.

A formal appeals process is not currently offered, and this section does not create one. Where Accounts and enforcement tooling are introduced, a defined review route will be described here.

28. Changes to this Policy

We update this Policy when the Services change — particularly when Accounts, Community, User Content, AI Features, or Premium Features are introduced — or where required by applicable law.

• The Last Updated date changes with every edit.
• The Version number increases: a MAJOR increase for a change to rights, obligations, or scope; a MINOR increase for clarification, formatting, or contact updates.
• A MAJOR change is reflected here before or at the time the relevant feature becomes active, and, once Accounts exist, announced at least 14 days before its Effective Date.
• Superseded versions are retained internally for reference.
• This Policy is reviewed at least every 12 months.
